Wealth Preservation and Preventive Law Special Alerts are patterned after an annual publication to all mountain climbers called "Accidents in North American Mountaineering" which writes up all mountaineering accidents describing the accident, what caused it, how it may have been prevented so that further mountain climbing catastrophes may be avoided. Wealth Preservation and Preventive Law Special Alerts are the equivalent of "Legal Accidents in North American Law" – a description of the legal catastrophe and how it may be avoided using preventive law techniques.
My brother Jim was at a family party when he started to feel a little strange. He developed a headache and started to feel weak and confused. The family was concerned and sat him down in the hopes that he would start to feel better. After several hours the symptoms still had not improved and the family became worried and drove him quickly to a nearby hospital. The hospital failed to diagnose a stroke and sent him home to rest. At home, Jim's symptoms became even more severe and an ambulance had to be called to rush him back to the hospital. This time the doctors confirmed that he had suffered a stroke; however, because he was not treated within a few hours after the stroke first struck, he was left with one side of his body paralyzed along with additional brain damage.
When Jim's family threatened to sue the hospital for malpractice in misdiagnosing his stroke during his first visit, the hospital was ultimately absolved of any liability because he didn't make it to the hospital until more than three hours after the stroke first appeared. Had he arrived at the hospital and been diagnosed correctly within that three hour window, Jim's now permanent brain damage may have been remedied through treatment. Any treatment after the first three hours is significantly less effective at preventing any permanent, debilitating damage such as the paralysis and brain damage that occurred with Jim.
Included with this alert is a copy of a medical alert given to me by my good friend Dr. Omer Reed. (Download) It tells us how to diagnose a stroke more easily so that we may rush the stroke victim to a hospital for remedial treatment within three hours and save the victim from debilitating or deadly consequences. It took Jim over a year of intensive medical treatment and exercise therapy for him to walk and talk again, however, he his still not the same person that he was before the stroke.
(Note: Although this is not a legal accident, it may well become one if you fail to follow the advice given herein.)
